TERMS AND CONDITIONS

PARTICIPANTS SHOULD READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING. YOU WILL BE DEEMED TO HAVE ACCEPTED THESE TERMS AND CONDITIONS AND AGREED TO BE BOUND BY THEM WHEN PARTICIPATING IN THIS PROMOTION. THESE TERMS AND CONDITIONS INCLUDE LIMITATIONS ON YOUR RIGHTS AND REMEDIES.

1. Spot The Ball Ltd. (the company)(‘Us’, ‘we’, ‘our’, ‘the promoter’) of 20-22 Wenlock Road, London N1 7GU whose registered company number is 13027342 is the operator of skilled based prize competitions through its website www.spottheball.com. Participants purchase tickets to enter and prizes are allocated in accordance with the following terms and conditions. They apply to the exclusion of any other terms that a participant seeks to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.

2.The competitions take place approximately every 30 days. See website for the dates of these.

3.Eligibility Criteria. 

  1. 3.1 Entry is only open to persons over the age of 18. By entering a competition the entrant ('entrant', 'you', 'your(s)') will be deemed to have legal capacity to do so, you will have read and understood these terms and conditions and you will be bound by them and by any other requirements set out in any related promotional material advertised on the website.

  3. 3.2 The competitions are governed by English Law and any matters relating to the competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction. By participating online via the website, and by accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our competitions. The promoter will not be held responsible for any entrant entering any of our competitions unlawfully. If in any doubt you should immediately leave the website and check with the relevant authorities in your country.

  5. 3.3 You must not be an employee or an immediate family member of Spot The Ball Ltd (the company). For the avoidance of doubt, an “immediate family member” shall mean any individual with any of the following relationships to the employee:
    1. spouse, and parents thereof;
    2. sons and daughters, and spouses thereof;
    3. parents, and spouses thereof;
    4. brothers and sisters, and spouses thereof;
    5. grandparents and grandchildren, and spouses thereof;
    6. grandparents and grandchildren, and spouses thereof;
    7. any individual related by blood or affinity whose close association with the employee is the equivalent of a family relationship.

4.Account:

  1. 4.1 You can enter the competition by registering an account online via the website by registering an email account or by signing in via a social media account, such as Facebook, Apple, Twitter or Google (‘Social Media Account’). This will be your username. Please note that only one username can be attributed to your account (either an email address or a social media account, but not both). You may change your username at a later date and open other accounts with different usernames. Each of these accounts will be regarded as a separate account.

  3. 4.2 It shall be your responsibility to ensure that the contact details associated with your account (including your email address and telephone number) are kept current and up to date. If for any reason these details are entered incorrectly, the promoter will not be held responsible. Entrants must carefully check their contact details have been recorded correctly.

5.Guest:

You may also enter as a ‘guest’ without registering an account or signing in via a social media account. It is imperative that if you chose this route to play that all of your contact details are accurate and up to date as in 4.2 above.

  1. 5.1 The cost of the tickets varies according to the value of the prizes on offer. These costs are advertised on the website. The maximum number of tickets that may be purchased through any one account for any one competition is 120. Payment is made online and once made, and once the payment has cleared, a confirmation email is sent to you. Entry into the competition is not accepted until this email has been sent. You will be required to tick a box confirming that you accept these terms and conditions.

  3. 5.2 Having selected the prize and purchased your selected number of tickets, you will be shown of photograph of a football match, then using your own skill and judgment, and by using the on screen target cursor you must select the location where you believe the judges will decide the centre of the ball should be if a ball was in the image. You do this by clicking on a grid. Each click on the grid equates to one ticket. The computer then registers each grid spot selected as your entry in the competition. You may repeat this process up to the full value of tickets purchased.

  5. 5.3 At the end of the competition, a panel of sports experts will determine using their sporting knowledge, where they think the centre of the ball should be. If your chosen centre of the ball location matches the judges centre of the ball location, you win the prize. The promoter reserves the right to change the panel of sports experts.

  7. 5.4 Please refer to the website for details of the start and end times of each competition.

6.Determination of the winner

  1. 6.1 Within 21 working days of the end of each competition the panel of experts shall meet to determine the location where they believe the centre of the ball to be. The promoter reserves the right to replace judges.
  2. 6.2 The judges’ decision shall be final.
  3. 6.3 Within 5 working days of that determination, the promotor will then identify if any of the entries match with the judges’ choice of position.
  4. 6.4 The winner will be contacted using the contact details on the entrant’s account or those details provided by the guest player.
  5. 6.5 If for any reason the promoter is unable to contact a winner within 5 days (which may be extended at the sole discretion of the promoter) of the end of a competition, or the winner fails to confirm acceptance of the prize, or the winner is disqualified as a result of contravening any of these terms and conditions, the winner will forfeit the prize and it will be awarded to the entrant with the next closest coordinates. For the avoidance of doubt, once the prize has been forfeited the original winner or tie break entrants will have no further claims against the promoter.

  7. 6.6 All winners will be required to send a copy of their passport to the promoter to confirm their identity, and age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorisation to use it, before any prize will be paid or delivered. Any failure to meet these obligations may result in the winner being disqualified and the promoter choosing an alternative winner.

7.Tie Break

  1. 7.1 In the event of a tie where two or more entrants have chosen identical locations to the judges, then the tied entrants will be asked to take part in another spot the ball challenge (‘the tie break’) using a new sporting photograph in order to determine a single first prize winner. This will be entered and judged on the same terms as the original spot the ball challenge and there will be no additional payment due.

  3. 7.2 In the event that this second tie break results in a further tie break, the tie break process will be repeated with the respective tied entrants until there is a single first prize winner.
  4.  
  5. 7.3 If the promoter is unable to contact one or more of the tie break entrants in the first or subsequent tie breaks within three working days (which may be extended at the sole discretion of the promoter) of identifying such tie break entrants, the tie break will be concluded without that particular tie break entrant taking part. The winner of the final tie break will receive the first prize selected (or cash prize if applicable).

8.Allocation of prizes

  1. 8.1 All prizes will be supplied tax free.
  2. 8.2 In the EU the first prize car will be delivered with UK VAT paid but any further costs (additional VAT/taxes/import duties/registration costs due in the destination/country of final registration) will be the responsibility of the first prize winner.
  3. 8.3 In all other countries the first prize car will be shipped (net of all taxes) to the nearest port and any applicable import duties, registration costs, or any further taxes or duties of any nature due in the destination country will be the responsibility of the first prize winner. The promoter reserves the right not to deliver to certain countries.
  4. 8.4 The promoter cannot guarantee that all prizes won, if exported, will conform to local standards in the destination country. It is the first prize winner's responsibility to check this and choose the cash alternative if appropriate.
  5. 8.5 No insurance or servicing amounts are payable on any car prizes. These are the sole responsibility of the entrant.
  6. 8.6 The promoter may store the chosen prize free of charge for 30 days after notifying the first prize winner, at the end of which time the selected prize will be delivered to the winner.

9.Personal data

  1. 9.1 Participants' names and general locations will be published or made publicly available if they are the winner of the promotion in accordance with regulatory requirements. In such circumstances, the promoter may also make free use of this information and the participants' photographs for publicity and public relations purposes, both during this and future promotions by the promoter or any of its associated or subsidiary companies in the UK. This includes making their name available on the promoter's websites and social media platforms.

  3. 9.2 All Entrants are automatically entered onto the promoter's database for the purpose of conveying information as to the status of their competition, as well as any future promotions or competitions offered by the promoter.

9.Personal data

  1. 9.1 Participants' names and general locations will be published or made publicly available if they are the winner of the promotion in accordance with regulatory requirements. In such circumstances, the promoter may also make free use of this information and the participants' photographs for publicity and public relations purposes, both during this and future promotions by the promoter or any of its associated or subsidiary companies in the UK. This includes making their name available on the promoter's websites and social media platforms.

10.Limits of Liability

  1. 10.1 The promoter makes no representations or warranties as to the quality or suitability of any of the cars offered as prizes.

  3. 10.2 Except for liability for death or personal injury caused by the negligence of the promoter, the promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize winner(s) and, where applicable, to any family/persons accompanying the winner(s), or in connection with any of the competitions promoted by the promoter.

  5. 10.3 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes. The promoter shall use its best endeavours to award the prize for a competition to the correct entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the promoter reserves the right to reclaim the competition prize and award it to the correct entrant, at its sole discretion and without admission of liability.

  7. 10.4 The promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due. The promoter shall use its best endeavours to ensure that the software and website(s) used to operate its competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the ticket coordinates recorded in our systems, howsoever displayed or calculated, shall be entered into the relevant competition and the promoter shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event.   9. 10.5 The promoter reserves the right to disregard any entries for any competitions that they, in their sole discretion, deem an abuse of the competition including but not limited to transactions that are not for the personal benefit of the account holder or guest player.
  10.  
  11. 10.6 The promoter reserves the right to remove any entrant to any competition where the promoter has reason to believe that an entrant has breached or tried to breach these terms and conditions or attempted to circumvent any security or operational procedures.

  13. 10.7 All decisions by the promoter are final and binding and no further correspondence will be entered into.
  14.  
  15. 8.8 The promoter may store the chosen prize free of charge for 30 days after notifying the first prize winner, at the end of which time the first prize will be delivered to the winner.

11.Extension of competition

  1. 11.1 The promoter reserves the right at its sole discretion to extend the closing date of any competition up to a maximum of 3 times, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition.

12.Alternative Prize

  1. 12.1 If by the closing date, the actual total value of the entry fees received from the sale of tickets by the promoter is less than the winning prize retail value or cash equivalent value, at the sole discretion of the promoter, the promoter can award a cash prize alternative payable to the winner being calculated as 90% of the total value of the total entry fees received up to the closing date net the promoter’s costs and overheads.

13.Early cancellation/ termination/modification/suspension of a competition

  1. 13.1 The promoter may in its sole discretion cancel, terminate, modify or suspend a competition, or invalidate any affected entries.
  2.  
  3. 13.2 In the event that the promoter closes a competition early without the selection of ball location by the judges, then the promoter may in its sole discretion either:
    1. close the competition and award each individual entrant a credit by way of tickets (equivalent to the number originally purchased by that individual entrant in the closed competition) for use in future competitions at no extra cost to the entrant, or
    2. refund the cost of entry by the participant

14.Data Protection Notice

  1. 14.1 Any personal data that you supply to the promoter or authorise the promoter to obtain from a third party, for example, a credit card company, will be used by the promoter to administer the competition and fulfil prizes where applicable. In order to process, record and use your personal data the promoter may disclose it to
    1. any credit card company whose name you give;
    2. any person to whom the promoter proposes to transfer any of the promoter's rights and/or responsibilities under any agreement the promoter may have with you;
    3. any person to whom the promoter proposes to transfer its business or any part of it;
    4. comply with any legal or regulatory requirement of the promoter in any country;
    5. prevent, detect or prosecute fraud and other crime.
     
  2. 14.2 In order to process, use, record and disclose your personal data the promoter may need to transfer such information outside the United Kingdom, in which event the promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
